Terms of Service

These Terms of Service ("Terms") govern your access to and use of NotShy's website, applications, and AI coaching features (collectively, the "Service"). By using the Service, you agree to these Terms. If you disagree, do not use the Service.

Eligibility

You must be at least the age of majority in your jurisdiction (and at least 13 years old) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Description of the service

NotShy provides educational and practice-oriented tools—including simulations and feedback—to help users build conversational confidence. The Service is not a substitute for professional medical care, psychotherapy, or emergency services. It does not diagnose or treat mental health conditions.

Your account and conduct

You are responsible for safeguarding any credentials and for activity under your account. You agree not to misuse the Service, including by: attempting to probe, scan, or test vulnerabilities; scraping or automating access beyond what we permit; infringing others' rights; uploading malware; harassing others; or using the Service for unlawful purposes.

User content

You retain rights to content you submit. You grant NotShy a limited license to host, process, and display that content solely to operate and improve the Service. You represent that you have the rights needed to grant this license. We may remove content that violates these Terms or applicable law.

AI outputs

Outputs from AI features may be inaccurate or inappropriate. You should not rely on them as professional advice. Use your judgment and seek qualified professionals when needed.

Intellectual property

The Service, including branding, design, text, and software, is owned by NotShy or its licensors and is protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works without our written permission.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTSHY AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).

Indemnity

You will defend and indemnify NotShy against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

Termination

We may suspend or terminate access to the Service if you breach these Terms or if we need to for legal or operational reasons. Provisions that by their nature should survive will survive termination.

Governing law

These Terms are governed by the laws applicable in your primary place of business or residence as we may specify in a separate agreement, or otherwise by the laws of the jurisdiction where NotShy operates, excluding conflict-of-law rules.

Changes

We may modify these Terms by posting an updated version. Material changes will be indicated by updating the "Last updated" date on this page. Continued use after changes constitutes acceptance.
